UPON the Court hearing oral argument from both parties on the pleaded grounds
AND UPON the Claimant raising multiple new grounds in the course of the hearing
AND UPON the Claimant making serious allegations against the Defendant and its legal services department of fraud, dishonesty and perjury, arising from an apparent discrepancy in the ‘Marden High School Behaviour for Learning Policy’ provided to the Court by the Defendant and a version of that policy which is publicly available online
AND UPON the Court adjourning the matter with directions, following which the question of permission to apply for judicial review will be determined on the papers, the parties agreeing that no further oral hearing will be necessary and accordingly that any right to renew any application orally is waived
IT IS ORDERED THAT:
- This claim is reserved to His Honour Judge Davis-White KC (sitting as a Judge of the High Court).
- Pursuant to CPR 39.2(4) and the Court’s inherent jurisdiction, the Claimant’s son shall be referred to in these proceedings, and in any judgment or order, by the cipher “HLF”. There must be no publication of any matter likely to lead to the identification of HLF. The anonymity and reporting restriction directions made by His Honour Judge Davis-White KC by his order dated 23 July 2026 shall apply equally to HLF, who is a Relevant Individual for the purposes of that order. Any person affected by this order may apply to vary or discharge it.
- The name of the Interested Party be amended to “The Governing Body of Marden High School”. The Defendant shall serve the Interested Party with the relevant documents including the claim form and statement of facts and grounds, the acknowledgment of service, all court orders, witness statements and skeleton arguments within 7 days of the date of this Order.
- The Defendant shall file and serve witness evidence clarifying its position in relation to the alleged discrepancy between the ‘Marden High School Behaviour for Learning Policy’ provided to the Court by the Defendant and the version of that policy which is publicly available online by 4pm on 5 August 2026, provided that nothing in this direction shall require the maker of the statement to give any answer or produce any document which might tend to expose that person to a criminal charge or penalty (privilege against self-incrimination).
- The Claimant shall file and serve a draft amended statement of facts and grounds, together with an application seeking permission to amend and any witness evidence on which he relies (on the application to amend, the application for permission or the application for interim relief), by 4pm on 12 August 2026.
- The Defendant shall file and serve amended grounds of resistance and any witness evidence in answer by 4pm on 21 August 2026.
- The Interested Party shall file and serve grounds of resistance and any witness evidence in answer by 4pm on 21 August 2026, if so advised.
- The Defendant shall file a composite electronic hearing bundle and an agreed authorities bundle by 4pm on 21 August 2026.
- The Claimant shall file and serve a skeleton argument and any further authorities on which he seeks to rely by midday on 25 August 2026.
- Should the Interested Party or the Defendant wish to file and serve a skeleton argument in response, they may seek permission from the Court to do so.
- The question of permission to apply for judicial review shall thereafter be determined on the papers, without a further oral hearing.
- Costs reserved.
