Order for interim relief and anonymity

UPON consideration of documents lodged by the Claimant

IT IS ORDERED THAT:

  1. The Defendant shall not relocate the Claimants to 24 Ruthrie Road, AB10 7HN, on 5 May 2026.
  2. Subject to further order, until 19 June 2026 (ie. the day after the Second Claimant’s last A- Level exam) the Defendant shall only relocate the Claimants to alternative accommodation if that accommodation is within a reasonable travel distance of The Charter School, East Dulwich, Jarvis Road, London SE22 8RB.
  3. The Defendant shall file and serve an Acknowledgement of Service and Summary Grounds for resisting the claim by 4pm on Tuesday 19 May 2026.
  4. Any Reply from the Claimants shall be filed and served by Friday 22 May 2026.
  5. The application for permission to apply for judicial review shall be determined on the papers by a Judge or a Deputy Judge in the week of 1 June 2026.
  6. The Claimant’s solicitors shall by 4pm on 6 May 2026 file and serve a written explanation as to why the child claimants have no litigation friend.
  7. Costs reserved.
  8. Liberty to the Defendant to apply to vary or discharge this Order on notice to the Claimants.

ANONYMITY ORDER

9. UPON it appearing that non-disclosure of the identity of the Claimant’s children [ie Second and Third Claimants] is necessary in order to protect the right to respect for private life of those children, pursuant to rule 39.2(4) of the Civil Procedure Rules and section 11 of the Contempt of Court Act 1981 and rules 5.4C of the Civil Procedure Rule.

10. The Claimant shall hereinafter be referred to in these proceedings as KGT and the Second and Third Claimants as KMK and KLM respectively (“the ciphers”). There is to be substituted for all purposes in these proceedings in place of references to the Claimants by name, and whether orally or in writing, references to their respective ciphers.

11. Pursuant to s.11 Contempt of Court Act 1981, there must be no publication of the identity of the Claimants or of any matter likely to lead to the identification of the Claimants in any report of, or otherwise in connection with, these proceedings.

12. Any person wishing to apply to vary or discharge this Anonymity Order may apply to the court on 72 hours’ notice to the parties.

OBSERVATIONS: I am persuaded that the test for interim relief is met on the papers before me. If the Defendant disagrees, she should apply for an urgent hearing. I have set case management directions for a speedy decision on permission to apply for judicial review. The claim needs to be resolved swiftly in the interests of the Claimants and also in the interests of the proper allocation of limited public resources for asylum support. The Claimants’
solicitor must give urgent consideration to a litigation friend for the children.
