Order

UPON the Court reviewing the Claimant’s application for permission for judicial review and the further applications identified in the judicial review claim form
And upon the court being satisfied that the medical report of Dr Galappathie dated 23 November 2023, together with the other documentation attached to the application for permission for judicial review, provides an arguable basis for interim relief concerning the Claimant’s continuing detention, but not an order prohibiting the Defendant from conducting an asylum interview at this stage
IT IS ORDERED THAT:

  1. For the purposes of these proceedings the Claimant shall be referred to as KHY.
  2. No person shall disclose or publish any document relating to these proceedings in such a manner as to identify the Claimant either directly or indirectly.
  3. Ms Karris Hamilton is appointed as the Claimant’s litigation friend.
  4. The Claimant’s application for interim relief/High Court bail shall be listed to be heard within 7 days of the date of this order, with a time estimate of 2 hours
  5. The Defendant shall file and serve a statement setting out his position on the application for interim relief/High Court bail no later than 24 hours before the interim relief hearing.
  6. The parties shall have liberty to apply on 24 hours’ notice to each other.
  7. The Claimant shall seek an order for interim relief in the following terms:
    The Claimant shall be released on bail to a suitable address on terms to be set, with liberty to apply.
  8. Further directions to be set on the determination of the application for interim relief.
