Order
UPON the Claimant filing an application for judicial review in the Administrative Court challenging the decisions of the Defendant dated 24 October 2025 to cancel the Claimant’s grant of indefinite leave to remain and decision dated 28 November 2025 refusing the Claimant’s application for naturalisation;
AND UPON the Claimant having also lodged an application for judicial review in the Special Immigration Appeals Commission challenging an exclusion decision made against him which is ongoing
BY CONSENT, it is ordered that:-
- Pursuant to the Claimant’s application for anonymity, the Claimant shall be referred to in these proceedings as “KLN” and pursuant to CPR 39.2 there shall be no publication of the name or address of the Claimant or any particulars of the case likely to lead to the identification of the Claimant without the leave of the Court.
- The Claimant’s application for Judicial Review in this Court is to be stayed pending the final outcome of the Claimant’s proceedings in the Special Immigration Appeals Commission.
- The Claimant is to notify the Court and the Defendant of the outcome of his proceedings within 28 days of the decision being handed down in the Special Immigration Appeals Commission.
- The parties to agree and to submit to the Court for its approval, new case management directions within 35 days of being notified of the decision being handed down, or if the parties cannot agree, submissions as to the case management directions sought.
