UPON reviewing the applications for anonymity by the Claimants, BAA and RG
AND UPON reading the two orders of the Honourable Mr Justice Sheldon dated 24 July 2024 (“the Orders”), and in particular paragraphs 4-5 of the Orders;
AND UPON considering a request by the BBC for copies of the Claim form, Statement of Facts and Grounds, Acknowledgement of Service and Reply in Claim No. AC-2024-LON- 001076;
IT IS ORDERED as follows:
- In each of the Orders, paragraph 5 is discharged and the following provisions are substituted.
- Pursuant to CPR 5.4C(4) and paragraph 4 of the Orders:
(a) the parties in each claim must by 4pm on 20 September 2024 file and send to the other parties a redacted copy of any statement of case filed by them, omitting the name, address and any other information likely to lead to the identification of BAA or RG;
(b) if any party considers that a redacted statement of case produced by any other party contains information likely to lead to the identification of BAA or RG, they may file and serve representations to that effect by 4pm on 27 September 2024;
(c) if no such representations are filed by that time, the court office may supply to the BBC redacted copies of the statements of case sought;
(d) if such representations are received, they are to be referred immediately to a High Court Judge;
(e) if any statement of case subsequently filed includes information likely to lead to the identification of BAA or RG, a redacted copy omitting that information must be filed at the same time;
(f) Unless the Court grants permission under CPR 5.4C(6), no non-party many obtain a copy of any unredacted statement of case. - Any person wishing to vary or discharge this Order must make an application, served on each party. The parties may respond within 3 clear days of the date on which the application is served on them. The application is thereafter to be referred to a High Court Judge for a decision.
