UPON consideration of the Claimant’s application of 14 September 2023 for interim relief
IT IS ORDERED THAT:

  1. The application is listed for a hearing in the Administrative Court on Thursday 21st September 2023, with a time estimate of 1 hour.
  2. The Defendant to file and serve a written response to the application by 2pm on Wednesday 20th September 2023.
  3. The identify of the Claimant shall not be disclosed.
  4. Liberty to apply to vary this order on notice to the Court and the Claimant;
  5. Costs in the case.

Reasons

C is an asylum seeker with ongoing proceedings before the Upper Tribunal (Immigration and Asylum). He has been homeless since February 2023. The Defendant granted him support pursuant to s95 of the Immigration and Asylum Act 1999 on 31 July 2023. To date, C is yet to be accommodated. C is sleeping in a tent. He is destitute and has significant mental health difficulties. Whilst the application requires prompt consideration, C has been homeless since February 2023 and accordingly it is appropriate to give the Defendant the opportunity to respond to the application. C has been granted anonymity by the Upper Tribunal.
