Consent order
UPON considering the Claimant’s claim for judicial review
AND UPON (1) the Court being satisfied that the publication of details leading to the identification of the Claimant in connection with these proceedings would constitute an interference with the Claimant’s rights under Article 8 of the European Convention on Human Rights; (2) the Court noting Article 11 of the Council of Europe Convention on Action against Trafficking in Human Beings; (3) the Defendant not opposing the application for anonymity; and (4) the Court being satisfied that the balance the Claimant’s rights under Article 8 ECHR and the principle of open justice, and rights of the press and public under Article 10 ECHR falls in favour of anonymisation
AND UPON the Defendant confirming that it accepts that the Claimant’s partner and children are persons reasonably expected to reside with him for the purposes of section 176(b) of The Housing Act 1996
AND UPON the parties agreeing that, in light of this acceptance, the claim for judicial review has become academic
BY CONSENT IT IS ORDERED:
Anonymity
1. The proceedings shall be anonymised in accordance with the following directions:
a. The proceedings shall be known as “R (LCV) v North Somerset Council”.
b. To the extent necessary to protect the identity of the Claimant, any other references, whether to persons or places or otherwise, be adjusted appropriately, with permission to the parties to apply in default of agreement as to the manner of such adjustments.
c. So far as the claim form, or any judgment or order, or any other document to which any person might have access pursuant to CPR r.5.4A-D at any time does not comply with the above, the Claimant’s solicitor has leave to file with the Court copies of such documents adjusted so as to comply. Such copies are to be treated for all purposes as being in substitution for the relevant originals.
d. A non-party may not inspect or obtain a copy of any document from the court file without the permission of a Judge. Any application for such permission must be made on notice to the Claimant (the court will effect service).
e. A non-party may not obtain any copy statement of case or other documents from the court file unless it has been anonymised in accordance with this paragraph.
f. Reporting restrictions apply as to the disclosing of any information that may lead to the subsequent identification of the parties.
g. Any non-party affected by this paragraph may apply on notice to set aside or vary this order.
Withdrawal
2. The Claimant has permission to withdraw his claim and the claim stands withdrawn.
Costs
3. The Defendant shall pay the Claimant’s costs, to be the subject of detailed assessment if not agreed.
4. There shall be a detailed assessment of the Claimant’s legal aid costs.
