CONSENT ORDER

UPON the Claimant having failed to validly serve the claim form on the Defendant within seven days of it being issued;


AND UPON the Defendant having decided to exercise its discretion to treat the Claimant as a Former Relevant Child;


AND UPON the Court having considered the Claimant’s application for an anonymity order (particularised in section 9.1 of the claim form and the accompanying witness statement and draft order);


AND UPON the Defendant adopting a neutral position on the Claimant’s application for an anonymity direction;


AND UPON the parties agreeing to settle.


BY CONSENT IT IS ORDERED THAT:

  1. The Claimant has permission to withdraw the above numbered claim for judicial review.

An anonymity direction is made in the following terms:

a. There be substituted for all purposes in this action, in place of references to the Claimant by name, and whether orally or in writing, reference to the letters “BOD”.

b. The Court file is to be retained by the Court and marked ‘Anonymised’. Pursuant to CPR 5.4C, a person who is not a party to these proceedings may obtain a copy of pleadings, a judgment or order from the Court records only if the pleadings, judgment or order has been anonymised such that the Claimant is referred to as “BOD” in those documents and any other identifying information has been removed.

2. There shall be no order as to costs.
