Order

UPON hearing Counsel for the Claimant and Counsel for the Defendants at a Case Management Conference on 6 May 2025

IT IS ORDERED THAT:

Variation to Case Management Directions

1. The parties may, by agreement in writing (prospectively or retrospectively), extend the time for a direction in this Order by up to 28 days without the need to apply to the Court, so long as any extension does not put at risk any hearing date. Beyond that 28-day period any agreed extensions of time must be submitted to the Court by email including a brief explanation of the reasons, confirmation that it will not prejudice any hearing date and with a draft consent order in Word format. The Court will then consider whether a formal application and hearing is necessary.

    ADR

    2. At all stages the parties must consider settling this litigation by means of Alternative Dispute Resolution (including mediation); any party not engaging in any such means proposed by another must serve a witness statement giving reasons within 21 days of receipt of that proposal; such witness statement must not be shown to the trial judge until questions of costs arise.

    Disclosure of Documents

    3. Disclosure is directed as follows:-

    (a) The Claimant shall provide ongoing and updating disclosure of documents every 4 months from 5 June 2025.

    Witness Evidence

    4. Evidence of fact will be dealt with as follows:

    (a) By 4pm on 15 April 2026 and 15 February 2027 the Claimant shall serve updated signed statements upon which he intends to rely and all notices relating to evidence.

    (b) Oral evidence will not be permitted at trial from a witness whose statement has not been served in accordance with this order or has been served late, except with permission from the Court.

    Expert Evidence

    5. Expert evidence is directed as follows:

    (a) The Parties have permission to rely upon expert evidence in the following disciplines: –

    Medical

    1. Neurorehabilitation

    2. Neurology

    3. Neuropsychiatry

    4. Neuropsychology

    5. Neuroradiology

    6. Educational Psychology

    (b) The Parties have permission to obtain and rely upon updated medical expert evidence from the experts listed in paragraph (a) and such reports to be served by 27 May 2027.

    (c) The medical experts in like discipline are to consult and prepare joint statements setting out those matters upon which they agree and those upon which they disagree with reasons for the latter, to be served by 5 August 2027.

    (d) The Parties have permission to obtain and rely upon non-medical expert evidence in the following disciplines:-

    Non-Medical

    1. Care/OT

    2. Speech and Language

    3. Court of Protection

    (e) By 19 June 2026, the parties must serve their reports from the experts at paragraph 5(d)(1)-(2).

    (f) By 28 October 2027, the parties must serve all other non-medical expert reports and updated reports from the experts at paragraph 5(d)(1)-(2).

    (g) By 9 December 2027 the non-medical experts in like discipline are to consult and prepare joint statements setting out those matters upon which they agree and those upon which they disagree with reasons for the latter.

    Further Case Management Conference

    6. There be a further Case Management Conference listed on the first open date after 6 March 2028 with a time estimate 2 hours

    Liberty to Restore

    7. There be liberty to restore for further Directions.
