Consent Order


It Is Hereby Ordered by consent that:


1. Until further Order, and with liberty to any person to apply in writing on notice to the parties to vary or discharge this paragraph of this Order: (a) pursuant to CPR 39.2(4), the anonymity of the Claimants and their children is protected and they shall be referred to as ‘MA’ and ‘KA’ respectively and (b) pursuant to CPR 5.4C, no person may obtain a copy of any document from the Court records without permission of the Court unless the Claimants’ solicitors have first had the opportunity to remove details which could lead to their identification;


2. The remainder of the Claimants’ application for interim relief is discharged in light of the agreement set out in this Order;


3. The Defendant shall no longer be required to file an acknowledgment of service in light of the agreement set out in this Order;


4. The Claimants’ claim for damages shall be transferred to the Queen’s Bench Division pursuant to CPR 30.5(2);


5. The Defendant shall pay the Claimants’ reasonable costs of bringing the claim up to the date on which this order is sealed, to be subject to detailed assessment if not agreed;


6. There shall be detailed assessment of the Claimants’ publicly funded costs.
