Order

On the Claimant’s application for permission to apply for judicial review, urgent consideration and interim relief;
Order by the Honourable Mrs Justice Cutts DBE

  1. Anonymity is granted.
  2. The Defendant is to respond to the application for interim relief by 12 noon Friday 24 February 2023.
  3. The matter is then to be put before the immediates judge unless either party considers there should be an oral hearing to determine the question of interim relief in which case the matter should be listed for hearing next week.

Reasons

  1. The applicants are both children under the age of 18. I consider anonymity is therefore appropriate.
  2. The applicants are currently residing in a one-bedroom flat with their brother. Whilst this may not be ideal they are not without accommodation in the short term.
  3. I do not in those circumstances consider it appropriate to make a mandatory order without hearing from the Defendant.
