CONSENT ORDER

UPON the Claimant having lodged his claim for judicial review on 21 August 2024 challenging the Defendant’s decision of 21 May 2024 that he is an adult;   

AND UPON the Defendant agreeing to withdraw the Initial Assessment of age dated 21st May 2024 and conduct a full Merton compliant age assessment;  

AND UPON the Defendant agreeing to provide accommodation and support to the   Claimant under the Children’s Act 1989 until a final determination as to age is made;  

AND UPON the Defendant transferring the Claimant to accommodation provided  under Section 20 of the Children’s Act 1989 on 4 September 2024.  

BY CONSENT IT IS ORDERED THAT:   

1.  The claimant is granted anonymity and shall be referred to in these proceedings as ‘MKAA’ 

2.  The Claimant’s application for permission for Judicial Review shall be withdrawn;  

3.  The Defendant shall pay the Claimant’s reasonable costs of this judicial review claim on a standard basis to be assessed if not agreed.  

4.  There shall be a detailed assessment of the Claimant’s legally aided costs.
