Anonymity order

On an application by the Claimant for an anonymity order and an application by the Defendant for a case management hearing

Following consideration of the documents lodged by the parties

ORDER BY THE HON. MRS JUSTICE EADY DBE

  1. Anonymity:

(a) Pursuant to CPR 39.2(4) and/or the Court’s inherent jurisdiction and/or s. 6 of the Human Rights Act 1998:

(i) the Claimant’s name is to be withheld from the public and must not be disclosed in any proceedings in public; and

(ii) the Claimant is to be referred to orally and in writing as MKC.

(b) Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or of any matter likely to lead to the identification of the Claimant in any report of, or otherwise in connection with, these proceedings.

(c) Pursuant to CPR 5.4C(4):

(i) the parties must within 7 days file a redacted copy of any statement of case filed, omitting the name, address and any other information likely to lead to the identification of the Claimant;

(ii) if any statement of case subsequently filed includes information likely to lead to the identification of the Claimant, a redacted copy omitting that information must be filed at the same time;

(iii) unless the Court grants permission under CPR 5.4C(6), no non-party may obtain a copy of any unredacted statement of case.

(d) Any person wishing to vary or discharge this Order must make an application, served on each party.

  1. Case management hearing:

(a) Pursuant to the Defendant’s application of 22 April 2026, a case management hearing will be listed in this matter, at which the Claimant’s application in respect of the expert evidence of Mr Foley will be considered and other directions given for the future progress of this case.

(b) The case management hearing will be listed with a time estimate of one hour on the first available date; the parties are to notify the Court forthwith if they consider the time estimate needs to be varied.

REASONS

Anonymity: The Claimant’s case raises issues such that there would be a risk to him and his family if he were to be identified in these proceedings. There are accordingly compelling reasons for the limited derogations from the principle of open justice in paragraph 1.

Order

UPON the Defendant’s application, dated 2 April 2026, made under section 6 of the Justice and Security Act 2013 (“the 2013 Act”)

AND UPON consideration of the documentation filed by the Defendant

AND UPON the Court being satisfied that the conditions in section 6(4) and (5) of the 2013 Act are met

ORDER BY THE HON. MRS JUSTICE EADY DBE

  1. These proceedings are hereby declared to be proceedings in which a closed material application (within the meaning of section 8 of the 2013 Act) may be made by the Defendant to the Court. For the purposes of section 6(8) of the 2013 Act, the party to the proceedings is the Defendant.
  2. The Defendant has permission pursuant to section 8 of the 2013 Act and rule 82.13 CPR not to disclose the sensitive material which is the subject of the application other than to the Court and to any person appointed as Special Advocate.
  3. The handling and storage of the closed material shall be undertaken by the Information Management Team at the Royal Courts of Justice, The Strand, London.
  4. Except as may otherwise be ordered, any hearing in relation to the proceedings shall not be published in the public cause list and shall be anonymised.
