BEFORE Alan Bates, sitting as a Deputy Judge of the High Court, on the papers
UPON the Claimant’s application for judicial review, made by an N461 Claim Form on 22 August 2025 which included an application for anonymity
AND UPON consideration of:
i. the Convention Rights in Schedule 1 to the Human Rights Act 1998, including specifically the Article 8 rights of the Claimant and his immediate family to respect for private and family life, and the Article 10 right to freedom of expression; and
ii. the common law principle of open justice
AND PURSUANT to section 6 of the Human Rights Act 1998, section 11 of the Contempt of Court Act 1980, and CPR rules 5.4C, 5.4D and 39.2(4)
WHEREAS for the purposes of this order:
iii. ‘Publication’ includes any speech, writing, broadcast, or other communication in whatever form (including internet and social media), which is addressed to the public at large or any section of the public.
iv. Publication for the purpose of this Order includes any further publication (as defined above) from the date of this Order, even if such information has derived from a previous stage or stages of these proceedings
IT IS ORDERED THAT:
- In these proceedings:
a. The names of the Claimant, members of his immediate family, and any address at which any of those persons resides, is to be withheld from the public and must not be disclosed in any proceedings in public.
b. The Claimant is to be referred to orally and in writing by the anonymising cipher
“MM”.
c. If any statement of case subsequently filed includes information likely to lead to the identification of the Claimant or a member of his immediate family, or reveals their home address, then a redacted copy omitting that information must be filed at the same time.
d. The Claimant’s solicitor shall file with the Court an electronic (PDF) bundle of the statements of case from which the Claimant has been anonymised, and family members’ names and addresses have been redacted, in accordance with this paragraph of this Order.
- Pursuant to CPR 5.4C(4), no non-party many obtain a copy of any unredacted statement of case except with the prior permission of the Court under CPR 5.4C(6). Any application for such permission must be made by way of a formal application notice and on notice to the Claimant.
- Pursuant to section 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or of any matter likely to lead to the identification of the Claimant or any member of his family, in any report of, or otherwise in connection with, these proceedings.
- The orders set out in paragraphs 1 to 3 above shall, in addition to applying in this Court, also apply to any proceedings in a county court upon issues or matters in the present proceedings being transferred by this Court to the county court, save to the extent that the county court makes a different order.
- Any person may apply to vary or discharge the orders set out in paragraphs 1 to 4 above. Any such application must be made by way of a formal application notice and on notice to the Claimant.
- Costs in the case.
