UPON the Claimant’s applications for judicial review and urgent consideration of 15 August 2025
AND UPON the Claimant’s applications for anonymity and expedition and upon it appearing to the Court on the basis of the evidence and submissions filed by the Claimant that the case is suitable for a substantial degree of expedition
IT IS ORDERED THAT:
- Pursuant to CPR r.39.2, the identity of the Claimant shall not be directly or indirectly disclosed. These proceedings shall be known as ‘MOH by his mother and litigation friend, HMO ) v Liverpool City Council.
- HMO is appointed as the Claimant’s litigation friend.
- The Defendant’s Acknowledgement of Service (CPR 54.8) must be filed and served by 4pm 14 days after the date of service of this Order and the Claim Form and supporting material upon the Defendant. The Claimant shall effect service of this Order and the Claim Form and supporting material upon the Defendant and shall file and serve a certificate of service to such effect.
- Any Reply from the Claimant (CPR 54.8A) must be filed and served by 4pm on 7 days after the date of service of the acknowledgment of service.
- The papers are to be referred to a Judge or Deputy Judge for a decision whether to grant permission to apply for judicial review or order a rolled-up hearing as soon as reasonably practicable thereafter.
- The parties shall have liberty to apply to vary or set aside this order on two working days’ notice to the other parties.
