UPON the Defendant’s Acknowledgement of Service dated 10 May 2023, Section 1, confirming that the claim is not contested.
AND UPON the Defendant now having decided the Claimant’s ECF funding review.
IT IS ORDERED BY CONSENT, AS FOLLOWS:

  1. The Claimant is granted anonymity pursuant to the terms of the Order for Anonymity.
  2. The Claimant has permission to withdraw his application for judicial review.
  3. The Defendant shall pay the Claimant’s reasonable costs of the claim, to be assessed if not agreed.
  4. There be a detailed assessment (if required) of the Applicant’s publicly funded costs in accordance with the Civil Legal Aid (Costs) Regulations 2013.
  5. Pursuant to CPR r 44.2(8), the Defendant shall make a payment on account of those costs, within 14 days of being served with a schedule of costs, in the sum of 60% of the schedule.
