Notification of the Judge’s decision on the application for permission to apply for judicial review (CPR 54.11, 54.12)
Following consideration of the documents lodged by the Claimant
ORDER by Susie Alegre sitting as a Deputy Judge of the High Court

  1. The application for permission to apply for judicial review is refused.
  2. Pursuant to CPR rule 39.2(4) there shall not be disclosed in any report of these proceedings the name or address of the Claimant or any details leading to his identification. If referred to, he shall only be referred to as ‘N’.
  3. Pursuant to CPR rule 5.4C, a person who is not a party to the proceedings may obtain a copy of the statement of case, judgment or order from the court records only if such document has been anonymised such that the Claimant is referred to in those documents as ‘N’ and any reference to his name or address has been deleted from those documents.
  4. No order for costs.

Reasons

1. The claim relates to alleged failures in the procedures of the Defendant with regard to the age assessment of the Claimant. However, the grounds, as pleaded relate to the treatment of the Claimant as a child and have become academic as, on his own case, the Claimant is now 18 and no longer a child

  1. Anonymity is granted as the Claimant is a young asylum seeker.
