ORDER by the Hon Mr Justice Robin Knowles CBE

  1. The Defendant shall not remove, attempt to remove, transfer for the purpose of removal, or set removal directions in respect of the Claimant pending the determination of this claim or further order of the Court.
  2. The Defendant shall, within 7 days of service of this Order, file and serve its answer to the evidence that the Claimant did provide an address or contact details (and that the Claimant’s asylum claim should not therefore have been treated as withdrawn).
  3. The Claimant may thereafter seek further directions, if necessary, for the further conduct of this claim.
  4. The Claimant shall be granted anonymity. No person shall publish or disclose any information likely to identify the Claimant. Throughout these proceedings the Claimant shall be referred to as NLY.
  5. Liberty to apply.

Reasons

The short starting point that may begin to resolve this case is the suggestion that D was wrong to treat the asylum claim as withdrawn because of an alleged failure to provide an address or contact point. C has evidence that she did. This does not seem yet to have been answered and it needs to be, and quickly. It should be capable of objective verification and then agreement may follow about the course that should now be taken to consider C’s position. I have made an order to hold the existing position in the meantime, even though that involves continuing detention while this starting point is addressed.
