Order
UPON hearing Counsel and Special Advocates at a directions hearing on 31st October 2024
AND UPON the court taking note that 2 of the Interested Parties in this case are under the age of 18 years old
AND UPON the Court indicating that non-disclosure of the identity of the Claimant and the Interested Parties is necessary in order to protect the interests of the children’s private lives, pursuant to rule 39.2(4) of the Civil Procedure Rules and section 11 of the Contempt of Court Act 1981 and rule 5.4C of the Civil Procedure Rules.
AND UPON the Court having directed that an agreed draft anonymity order be filed for the court’s approval.
ORDER
IT IS ORDERED
I. That the Claimant shall hereinafter be referred to in these proceedings as NT and the Interested Parties as BHT, BANT, BAT, BKT, BHST, BABT, BMYT and BMNT.
II. Pursuant to CPR rule 39.2(4) there shall not be disclosed in any report of the proceedings the name or address of the Claimant or his family members; and the Claimant and the Interested Parties, if referred to, shall only be referred to by the letters set out in paragraph I as above.
III. Pursuant to CPR Rule 5.4C a person who is not a party to the proceedings may obtain a copy of a statement of case, judgement or order from the court records only if the statement of case, judgement or order has been anonymised such that
(a.) the Claimant and Interested Parties shall be referred to in those documents
only by the letters in para I above and
(b.) any reference to the name of the claimant and of the Interested Parties shall be
deleted from those documents
IV. Any person affected by this Order may apply on notice to all parties to have this
Order set aside or varied.
