Order

UPON considering the papers and noting that two of the interested parties are children who do not appear to be conducting the proceedings with a litigation friend (“the children”)

AND UPON it appearing that non-disclosure of the identity of the claimant and the interested parties is necessary in order to protect the interests of the children’s private lives, pursuant to rule 39.2(4) of the Civil Procedure Rules and section 11 of the Contempt of Court Act 1981 and rules 5.4C of the Civil Procedure Rules

IT IS ORDERED

i. The claimant shall hereinafter be referred to in these proceedings as NZ; and the interested parties as HNZ, SNZ, INZ and KNZ.
ii. Pursuant to CPR rule 39.2(4) there shall not be disclosed in any report of the proceedings the name or address of the claimant or his family members or any details leading to the identification of the claimant or his family members and the claimant and the interested parties, if referred to, shall only be referred to by the letters in para i above.
iii. Pursuant to CPR rule 5.4C a person who is not a party to the proceedings may obtain a copy of a statement of case, judgment or order from the court records only if the statement of case, judgment or order has been anonymised such that: (a) the claimant and interested parties are referred to in those documents only by the letters in para i above; and (b) any reference to the name of the claimant and the interested parties shall be deleted from those documents.
iv. Any person affected by this Order may apply on notice to all parties to have this Order set aside or varied.

AND:

v. The claimant shall within 7 days of the sealing of this Order file the name and description of a litigation friend for each of the children pursuant to CPR 21.4 together with certificates of suitability pursuant to CPR 21.5; or file and serve an application under CPR Part 23 for the appointment of litigation friends by court order pursuant to CPR 21.6.

AND:

vi. This Order is made by the court of its own motion in order to protect the interests of the children.
vii. No order for costs.
viii. Liberty to apply.
