UPON reading the documents lodged by the Claimant

AND UPON the Claimant seeking an order that the Defendant provide a response to the Claimant’s interim relief application by 5 January 2025, and the application for interim relief, which seeks an order for the Defendant to provide the Claimants with adequate accommodation in Oxford within a reasonable distance of Bayards Hill Primary School, or, in the alternative, a prohibitory injunction preventing the Defendant from dispersing the Claimants outside of the Oxford area pending the substantive claim, and an order for anonymity;

AND UPON the Court being satisfied that an order for the Claimants anonymity is necessary to secure the proper administration of justice and to protect the interests of the Claimants and their children;

IT IS ORDERED

  1. Pursuant to r. 39.2, the Claimants shall be referred to as “BM”, “SL”, and “MB” in these proceedings, and the matter shall be listed as and known as “R (OAA BSM) v Secretary of State for the Home Department”.  
  2. The publication of any information likely to identify the Claimants or their family is prohibited.
  3. BM is appointed as MB’s litigation friend.
  4. The Defendant shall provide a written response to the Claimants interim relief application by 4pm on 9 January 2025.
  5. The Claimant’s interim relief application to be considered within 10 working days of receipt of the Defendant’s response, or in the absence of a written response from the Defendant, within 10 working days of the deadline for the Defendant’s written response.
  6. The Defendant be prohibited from dispersing the Claimants outside the Oxford area pending determination of the interim relief application.
  7. Costs reserved.
