ORDER
UPON APPLICATION by the Defendant by Application Notice dated 14 February 2025 for an Order for restrictions in respect of the Confidential Schedule to the Defence (the “Confidential Schedule”) which contains the true identities of individuals referred to by pseudonym in the Defence (the “Relevant Individuals”).
AND UPON READING the First Witness Statement of Alex Wilson and its Confidential Annex (the “Confidential Annex”) and the exhibit to that Statement, including the correspondence with those acting for the Claimant herein
AND UPON the Defendant having served the Claimant with the Defence and Confidential Schedule, and filed the Defence (without the Confidential Schedule) on 14 February 2025
AND UPON this Order enabling the ring to be held pending the consideration of such application as might be made at the CCMC, when oral submissions can be heard
WITHOUT A HEARING pursuant to CPR r 23.8(1)(c)
IT IS ORDERED THAT:
- The Confidential Schedule and the Confidential Annex shall be kept confidential by the Court, unless otherwise ordered, and shall be marked “confidential” on the CE-File.
- The Confidential Schedule and the Confidential Annex shall only be used by the parties for the purpose of these proceedings.
- A person who is not a party to these proceedings (a “Non-Party”), may not obtain from the Court record a copy of the Confidential Schedule and/or Confidential Annex without the permission of the court in accordance with CPR 5.4C(4)(a).
- Any Non-Party wishing to obtain a copy of the Confidential Schedule and/or Confidential Annex from the court file must make an application using form N244. Any such application must be made with 5 clear days’ notice to the parties.
- In any statement of case, witness statement, skeleton argument or any other document produced for the purposes of these proceedings and filed with the Court the Relevant Individuals must be identified only by the pseudonym given in the Defence and Confidential Schedule.
- The orders in paragraphs 1-5 above shall be in place until the CCMC with liberty for the parties to apply for the order to be extended at the CCMC.
- The time for filing the Confidential Schedule is extended to 1 clear day after service of a sealed copy of this Order by the Court.
- Liberty to apply, including to any third party affected by this order, such application to be made in writing on at least 5 clear days’ notice and supported by evidence.
- Costs in the case.
