Order

On an application by the Claimant for anonymity and expedition

Following consideration of the documents lodged by the Claimant.

ORDER BY HIS HONOUR JUDGE ANTONY DUNNE SITTING AS A DEPUTY HIGH COURT JUDGE

  1. Pursuant to CPR 39.2(4) and the Court’s inherent jurisdiction.
    (a) No person shall identify the Claimant in connection with these proceedings. The Claimant shall be referred to as “PHC” and the litigation friend as “KHC”.
    (b) A non-party may not obtain or inspect a document filed with the Court and to which a non-party may have access pursuant to CPR 5.4 or otherwise, unless it has been edited so as to comply with paragraph 1 of this order.
    (c) Anyone affected by the terms of this order shall have permission to apply to set aside or vary it on 3 days working notice.
  2. The time for filing an acknowledgment of service remains as 21 days after service of the claim.
  3. Any reply must be filed within 7 days after the service of the acknowledgement of service.
  4. The permission application must be placed before a judge for consideration on the papers within 14 days after service of any reply from the Claimant. The application for permission to be considered orally without consideration on the papers is refused.
    Reasons
  5. The Claimant is a 7 year old child and the claim relates to her educational needs and refers to sensitive detail about her health. I am satisfied the order is necessary to protect PHC’s interests and the importance of protecting these interests, reflected in the terms of the order at paragraph 1, outweighs the public interest in open justice
