Order
UPON the claim of the Claimants for relief under section 48 of the Administration of Justice Act 1985 (the “Claim”)
AND UPON having considered an opinion of Edward Cumming KC (the “Opinion”)
AND UPON hearing Edward Cumming KC, and Jessica Lavelle, counsel for the Claimants, in private, pursuant to the order of Master McQuail dated 29 September 2025
IT IS HEREBY ORDERED THAT:
- This anonymised version of the order, which anonymises the names of the parties, shall be published forthwith on www.judiciary.gov.uk.
- Any person may apply, on notice to the Claimants’ solicitors (whose contact details appear at the end of this order), to set aside or to vary paragraph 3 below.
- Subject to paragraph 1 above, the Court file shall remain marked “In Private” and no documents, including for the avoidance of doubt any recording or transcript of any part of the proceedings, (with the exception of this anonymised order or the anonymised order of Master McQuail dated 29 September 2025) are to be released to anyone except the Claimants or the Claimants’ solicitors, without further order.
- The Claimants be authorised to administer the CYB Trust, and to take any step in relation to the CYB Trust, (including, for the avoidance of doubt, to exercise, and to consider the exercise, of all and any powers as may, from time to time, be vested in them as trustees of the CYB Trust) on the basis that the Child (as defined in the judgment of Master McQuail dated 14 November 2025) is a beneficiary of the CYB Trust in reliance on the Opinion.
- For the avoidance of doubt, the Claimants’ may inform the adult beneficiaries of the CYB Trust and the parents of the Child that the court has made an order in the terms of paragraph 4 above.
- The Claimants’ costs of the claim shall be paid from the CYB Trust.
- The Court shall provide (i) a sealed copy of this anonymised version of the order, and (ii) a sealed copy of the order in which the parties’ names have not been anonymised to the Claimants’ solicitors.
