UPON the First Defendant recording the Claimant’s further submissions as an asylum claim on 25 April 2023;
AND UPON considering the Defendants’ Acknowledgment of Service, the First Defendant’s Letter to the Court of 19 May 2023 and the Claimant’s Application Notice of 22 May 2023.
IT IS ORDERED
- Pursuant to CPR r.39.2(4), the Claimant’s name be anonymised throughout these proceedings, and he is to be known as ‘PUX’. No report of these proceeding may identify the Claimant directly or indirectly. Any non-party may apply to the Court on paper to discharge this paragraph of this order, but any such application must be made on 7 days’ written notice to the parties.
- The Claimant has permission to withdraw this claim for Judicial Review.
- There be the following directions for submissions on costs:
i) The First Defendant may file and serve submissions as to what the appropriate order for costs should be by 6 June 2023. Where the First Defendant does not file submissions the First Defendant will be ordered to pay the Claimant’s costs of the claim on the standard basis and for these to be the subject of detailed assessment if not agreed.
ii) Where submissions are filed and served by the First Defendant, the Claimant or any other party may file and serve submissions in reply within 14 days of the service of those submissions. Where no submissions are filed by the Claimant or by any other party in accordance with the above, the Court will make the Order sought by the First Defendant.
iii) Where submissions are filed by the Claimant or by any other party, the First Defendant shall have 7 days in which to file and serve a reply. If the Court thinks it necessary in the interests of justice, it may seek any further submissions from any party. A party may also apply for permission within 14 days of the service of previous submissions to lodge further submissions provided it explains what new point has arisen in those previous submissions to which it needs to reply. - In any event, there be detailed assessment of the Claimant’s legal aid costs.
