Consent Order

UPON the Claimants having issued proceedings on 22 December 2022 with an application for an immediate stay of proceedings for 28 days, that application having not yet been determined;

AND UPON the Claimants making an application for an anonymity order on 22 December 2022, that application having not yet been determined;

AND UPON the Defendant agreeing to provide the Claimants with accommodation together within 1 hour of travelling distance by public transport from their uncle’s residence in Maidstone on 30 December 2022;

AND UPON the Defendant providing the Claimants with self-contained accommodation together pursuant to section 95 of the Immigration and Asylum Act 1999 on 10 March 2023 which is 1 hour and 13 minutes travelling distance by public transport from their uncle’s residence, for such period as the Claimants remain entitled to such support;

AND UPON the Claimants making an application on 28 March 2023 to withdraw their claims for judicial review

AND UPON the Defendant confirming in its letter to the Court dated 6 April 2023 its agreement that the Claimants withdraw their judicial review claims;

AND UPON the Claimants and Defendant agreeing that this application for permission to apply for judicial review is academic

BY CONSENT, IT IS ORDERED THAT:
1. Pursuant to CPR r. 39.2, identification of the Claimants is prevented, and the matter be known as R (IO & AO) v Secretary of State for the Home Department.
2. The Claimants shall withdraw their claims for judicial review and their claims are hereby withdrawn.
3. The Defendant do pay 60% of the Claimants’ reasonable costs on the standard basis incurred in these proceedings, to be assessed if not agreed.
4. The Claimants’ publicly funded costs to be subject to detailed assessment in accordance with the Civil Legal Aid (Costs) Regulations 2013 and CPR 47.18.
