Order

On an application by Claimant for anonymity, abridgement of time and expedition
Following consideration of the documents lodged by the Claimant (and an email dated 13 March 2024 which indicated that anonymity was not opposed but expedition and the abridgement of time was opposed).

ORDER by Dan Kolinsky KC sitting as a Deputy Judge of the High Court

1. The Claimant is granted anonymity under CPR39.2(4) and shall be referred to in these proceedings as ‘RB’.

2. Time for filing an Acknowledgment of Service is abridged to 14 days from the date of service of the sealed claim form.

3. The Court shall make a decision on permission by 12 April 2024.

4. Costs reserved.

Reasons

1. I am satisfied that anonymity is appropriate in this case as the claim concerns sensitive, health and personal information relating to the Claimant and her daughters.

2. I am satisfied that there is sufficient urgency arising from the Claimant’s situation to justify abridging time for the Defendant to file its acknowledgment of service and make an order which expedites the permission stage.

3. I have set a timetable for the determination of the permission stage of these proceedings. I note that the claim does not seek interim relief in the claim. It will be for the judge determining permission (with the benefit of the Defendant’s response) to decide whether any substantive (or other) hearing should be expedited.
