UPON the parties having agreed terms in full and final settlement of the Claimant’s claim against the Defendant herein
AND UPON the terms of that settlement being set out in the Settlement Agreement, dated 22 May 2024
AND UPON the parties having regard to the requirements of Part 21 of the Civil Procedure Rules;
AND UPON the Court reading and considering the relevant documents (attached to this order in Annex A);
AND UPON the Court being satisfied that this settlement satisfies Part 21 of the Civil Procedure Rules.
BY CONSENT IT IS ORDERED THAT:
1. Pursuant to CPR r.39.2, the identity of the Claimant shall not be directly or indirectly disclosed and these proceedings shall be known as ‘R(RS)(by their litigation friend, NS) v Bradford Metropolitan District Council’.
2. The Court approves the child infant settlement in the above matter on the terms as set out within the attached Settlement Agreement dated 22 May 2024 below.
3. All further proceedings in this action between the Claimant and the Defendant shall be stayed upon the terms set out in the attached Settlement Agreement dated 22 May 2024 , except for the purpose of carrying out the terms of the agreement into effect and for that purpose the parties have permission to apply.
4. The Defendant shall pay a contribution to the Claimant’s costs on the standard basis on the terms as set out within the attached Settlement Agreement dated 22 May 2024.
