Rule 14 order

Anonymity order

  1. The appellant’s representative asks that the names of the appellant and his father and mother be the subject of an anonymity order. The respondent’s representative does not object. The Upper Tribunal agrees to the order, because the appellant has a reasonable expectation of privacy because of issues of mental ill health and addiction to drugs and alcohol with a forensic history and, as his current whereabouts are unknown, it is not possible to manage delivering news of the decision. The order extends to his mother and father to protect the appellant’s privacy.
  2. Pursuant to rule 14(1) of the Tribunal Procedure (Upper Tribunal) Rules 2008, the Upper Tribunal prohibits the disclosure or publication of—

a. the name of each of the following in relation to these proceedings—

i. the appellant;

ii. the appellant’s father;

iii. the appellant’s mother.

b. any matter likely to lead members of the public to identify any of the persons mentioned at subparagraph (a) above.

Breach

  1. Any breach of the order at paragraph 2 above is liable to be treated as a contempt of court and punished accordingly (see section 25 of the Tribunals, Courts and Enforcement Act 2007). Punishment can be imprisonment for up to two years, or a fine, or both.
