Following consideration of the papers in the case including the Claimant’s application for an anonymity order
And upon
(1) Consideration of the Article 8 rights of the Claimant to respect for private and family life, and the Article 10 right to freedom of expression.
(2) It appearing that non-disclosure of the identity of the Claimant is necessary to secure the proper administration of justice and in order to protect the interests of the Claimant and his family due to his personal history and circumstances and that there is no sufficient countervailing public interest in disclosure.
ORDER by Upper Tribunal Judge Ward sitting as a Judge of the High Court
It is hereby ORDERED:
- The Claimant’s application for an anonymity order is granted under CPR r. 39.2(4) and/or the general case management powers in CPR r. 3.1(2). The Claimant in this action shall have anonymity until further order. No report or publication of these proceedings shall directly or indirectly identify the Claimant. Pursuant to CPR r.5.4(c), a person not a party to the proceedings may obtain a copy of the statement of case, judgment or order of the court records, only if the statement of case, judgment or order from the court has been anonymised. In the case title, the Claimant’s name shall be replaced by the initials ‘SK’. Failure to comply with this Order could lead to contempt of Court proceedings.
- In accordance with the “Practice Guidance : Publication of privacy and Anonymity Orders” dated 16 April 2019, a copy of this order is to be published on the website of the Judiciary of England and Wales.
