UPON the filing and service of the claim, statement of facts and grounds and evidence on the Defendant on the 15 December 2022 prior to receiving the sealed bundle and also the sealed claim of the 16 December 2022.
AND UPON the Defendant confirming by email at 5.01 pm on the 22 December 2022 suitable bail address in Essex at 63-65 Butts Green Road, Hornchurch, RMll 2JS which lies outside the areas where the claimant was subject to exploitation as identified in the positive grounds decision that the Claimant is a victim of modem slavery.
AND UPON the claimant no longer seeking any remedy from the court and seeking permission to withdraw his claim for judicial review.
IT IS HEREBY ORDERED THAT:
- The Claimant do have permission to withdraw this claim for judicial review and permission to withdraw without a litigation friend pursuant to CPR r 21.2(3).
- The claim and order be anonymised as the Claimant Is a minor pursuant to CPR r 39.2(4) and known as TB.
- The Defendant to pay the claimant’s costs limited to the Court fee and Counsel’s fees.
- There shall be a detailed assessment of the Claimant’s publicly funded costs.
