Order
UPON the Commission having ordered on 27 November 2024 (in its order as amended on 2 December 2024) that the anonymity order made by the Chairman on 15 May 2023 would be lifted with effect from 12 December 2024.
AND UPON the Administrative Court on 11 December 2024 having directed the Commission to take such steps as were required to maintain in place the Claimant’s anonymity pending a hearing of the Claimant’s application for judicial review or a final refusal of his application for permission to appeal (or no in-time application for permission to appeal being made)
AND UPON the Administrative Court on 16 December 2024 discharging its order of 11 December 2024
IT IS ORDERED:
- For the avoidance of doubt, the anonymity order made by the Chairman on 15 May 2023 no longer has effect.
REASONS
- By an order dated 16 December 2024, the Divisional Court discharged its order of 11 December 2024 granting the Applicant interim relief against an earlier order of the Commission lifting the Chairman’s order of 15 May 2023 which provided for the applicant’s anonymity and for him to be known as “H6”.
- In light of the order of the Divisional Court, the applicant shall no longer be anonymised in these proceedings and may therefore be identified as Tengbo Yang.
- The Commission now confirms that the anonymised references to A Ltd, B Ltd and the C Initiative in its judgment dated 12 December 2024 should be read as follows:
(a) “A Ltd” means Hampton Group International Limited;
(b) “B Ltd” means Newland UK Ltd;
(c) “The C Initiative” means “Pitch@Palace”.
