UPON the Claimant’s renewed application for permission to apply for judicial review

AND UPON hearing Mr Tim Buley KC, counsel for the Claimant, and Ms Cecilia Ivimy KC, counsel for the Defendant

IT IS ORDERED THAT:

1) Pursuant to CPR 39.2(4) and/or the Court’s inherent jurisdiction and/or s. 6 of the Human Rights Act 1998:
a) the Claimant’s name is to be withheld from the public and must not be disclosed in any proceedings in public; and
b) the Claimant is to be referred to orally and in writing as TSZ.
2) Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or of any matter likely to lead to the
identification of the Claimant in any report of, or otherwise in connection with, these proceedings.
3) Pursuant to CPR 5.4C(4):  
a) the parties must within 7 days file a redacted copy of any statement of case filed, omitting the name, address and any other information likely to lead to the identification of the Claimant
b) if any statement of case subsequently filed includes information likely to lead to the identification of the Claimant, a redacted copy omitting that information must be filed at the same time;
c) unless the Court grants permission under CPR 5.4C(6), no non-party many obtain a copy of any unredacted statement of case.
4) Any person wishing to vary or discharge paragraphs 1 – 3 of this Order must
make an application, served on each party.
5) The Claimant’s renewed application for permission to apply for judicial review is
refused.
6) No order as to costs.

UPON the Claimant having filed a judicial review claim on 30th June 2025

AND UPON the Claimant having sent the Defendant a letter before claim dated 24th June 2025 pursuant to the Judicial Review Pre-Action Protocol (“the Letter Before Claim”)

AND UPON the parties having agreed that the claim can proceed without the need for a reply by the Defendant to the Letter Before Claim

IT IS ORDERED THAT:

  5. The Claimant shall by 4pm on 15th August 2025 either:
    a. file and serve an amended Statement of Facts and Grounds and amended claim bundle with evidence in support; or
    b. file and serve a Notice of Discontinuance.
  6. Unless the Claimant files and serves such a notice of discontinuance the Defendant shall file and serve an Acknowledgement of Service and Summary Grounds of Resistance by 4pm on 12th September 2025.
  7. The Claimant shall file and serve any Reply by 4pm on 26th September 2025.
