Order

On an application by the Claimant for directions in relation to his application for interim relief
Following consideration of the documents lodged by the Claimant
ORDER by the Honourable Mrs Justice Heather Williams DBE

  1. The Defendant shall file and serve any response to the Claimant’s application for interim relief by 4pm on 28 June 2023.
  2. The Claimant shall file and serve any reply to the document referred to at paragraph 1 by 4pm on 30 June 2023.
  3. The Claimant’s application for urgent relief shall be placed before a Judge of the Administrative Court within three working days thereafter.
  4. If the Claimant seeks anonymity in relation to these proceedings, an application to that effect must be filed and served by 4pm on 28 June 2023.
  5. The Claimant is to be referred in these proceedings as “TVD” and identifying details are not to be published in relation to him. This order is to remain in effect until the date specified in paragraph 4, or, if an application for anonymity is made, until determination of the same (whichever is the later).
  6. Liberty to both parties to apply to vary or set aside the above orders on at least two working days’ notice.
  7. Liberty to apply, including to the press, to apply to vary or set aside the order at paragraph 5 above on at least two working days’ notice.
  8. Costs reserved.

Reasons

  1. It is appropriate (as the Claimant proposes) to give the Defendant an opportunity to respond to the application for interim relief. I have also made provision for a reply from the Claimant, if so advised. The timescales take account of the circumstances of this case.
  2. The title of the proceedings in the draft order provided by the Claimant indicates that anonymity is sought. However, no application has been made to that effect and the matter is not addressed in the material supplied. As an anonymity order is an incursion on open justice it must be justified and a formal application should be made to that effect, if this is pursued. However, I have made provision for a basic, time-limited anonymity order to hold the ring in the interim.
