Declaration and order

UPON the defendant’s application, dated 25 April 2024, made under section 6 of the Justice and Security Act 2013 (“the 2013 Act”) and in accordance with CPR 82.9

AND UPON the court having considered the witness statement of Noel Doran dated 24 April 2024 and its exhibit ND1

AND UPON the court being satisfied that the conditions in section 6(4) and (5) of the 2013 Act are met

THE HON SIR PETER LANE (sitting as a High Court Judge)

1) The proceedings are hereby declared to be proceedings in which a closed material application (within the meaning of section 8 of the 2013 Act) may be made by the defendant to the court. For the purposes of section 6(8) of the 2013 Act, the party to the proceedings is the defendant.

2) The claimant is not to be served with the closed material or the defendant’s application to proceed under section 6, save for further order of the court.

3) The defendant’s application and any material to which the closed material procedure applies shall be made available to the special advocate, once instructed.

4) The handling and storage of the closed material shall be undertaken by the Information Management Team at the Royal Courts of Justice, Strand, London.

5) Except as may otherwise be ordered, any hearing in relation to the proceedings shall not be published in the public cause list and shall be anonymised.
