The applicants are granted anonymity and shall be referred to as XY and AB during these proceedings
By 4pm on 10 March 2026, the applicants shall file and serve:
(i) evidence to show that the pre-action letter of 6 November 2025 was served on the respondent
(ii) evidence to show that these proceedings were served on the respondent
Reasons
Given that the underlying claim is for international protection, I grant the application for anonymity.
This is a most unusual case. Despite the claim (in the pre-action letter and the first ground for judicial review) that the respondent’s decision is vitiated by serious procedural impropriety, the respondent has apparently not responded to the pre-action letter and has not filed an Acknowledgement of Service. I cannot immediately bring to mind another case in which that has happened, and I am not willing to make a decision on the application for permission without evidence to show that the respondent is at least on notice of the points which are pursued.
