UPON the Claimant’s application for judicial review of the First Defendant’s decision to detain him under immigration powers and omission to provide him with suitable accommodation; and for judicial review of the Second Defendant’s omission to assist him to obtain, or facilitate the obtaining of, suitable accommodation

AND UPON the Claimant applying for urgent interim relief

IT IS ORDERED:

  1. The Claimant’s application for interim relief is to be determined at a hearing on Wednesday 7 February 2024. Time estimate: 2 hours.
  2. The Defendants must file and serve submissions setting out their position on interim relief by 4.30pm on Thursday 1 February 2024;
  3. The Claimant is to file and serve any response to those submissions by 4.30pm on Monday 5 February 2024;
  4. The Claimant shall be anonymised and known throughout these proceedings as ‘YA’ until further order;
  5. Liberty to apply to vary or discharge this order on 2 days’ notice to the other party; and
  6. Costs reserved.

Reasons

The Claimant is currently in immigration detention. It appears to be accepted that he should be released into suitable accommodation and requires a care plan. However, I am not prepared to make an order for such accommodation and a care plan to be provided within 7 days without giving the Defendants an opportunity to make submissions. I have listed a hearing which gives the Defendants a reasonable period of time to respond in writing to the interim relief application, as they are required to do, as well as giving the Claimant an opportunity to respond.
