AND UPON considering this application on the papers.
AND PURSUANT TO section 6 the Human Rights Act 1998, taken with Article 8 of the European Convention on Human Rights, CPR 39.2, CPR 5.4C, and the Court’s inherent jurisdiction.
AND UPON the Master being satisfied that it is strictly necessary to secure the proper administration of justice.
IT IS ORDERED THAT: Anonymity
1. The Intended Claimant be permitted to issue the intended proceedings using the letters “YXE” and giving an address c/o the Intended Claimant’s solicitors. A copy of the claim form with the Intended Claimant’s full name and address is to be placed on the electronic file and marked “confidential” and is not to be opened without the permission of a Judge or Master of the Queen’s Bench Division.
2. There be substituted for all purposes in these proceedings in place of references to the Intended Claimant by name, and whether orally or in writing, references to the letters “YXE”. Access to Documents
3. No copies of (a) the confidential exhibits to Mr Kelly’s Witness Statement, (b) the confidential exhibits to any further witness statements given in the intended proceedings shall be provided to a non-party without further order of the Court.
4. A non-party may not obtain or inspect a copy of any Statement of Case or any other document filed with the Court and to which a non-party may have access pursuant to CPR 5.4A-D (or otherwise), unless it has been produced or edited so as to comply with paragraph 2 of this Order or any subsequent direction made by the Court.
