Order
On the claimant’s application for directions relating to anonymity
Following consideration of the documents lodged by the claimant
ORDER by the Hon. Mr Justice Chamberlain:
1. Pursuant to the court’s inherent jurisdiction and s. 6 of the Human Rights Act 1998:
a. the claimant’s name is to be withheld from the public and must not be disclosed in any proceedings in public; and
b. there is to be substituted for all purposes in these proceedings, in place of references to the claimant by name, and whether orally or in writing, the letters “YXY”.
2. Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the claimant or of any matter likely to lead to the identification of the claimant in any report of, or otherwise in connection with, these proceedings.
3. Pursuant to CPR 5.4C(4):
a. the parties must, when filing any statement of case, also file a redacted copy of that statement of case, omitting the name, address and any other information which could lead to the identification of the claimant; and
b. unless the Court grants permission under CPR 5.4C(6), no non-party many obtain a copy of any unredacted statement of case.
4. Any person wishing to vary or discharge this Order must make an application to the Court, served on each party.
Reasons
The claimant is an asylum seeker and there is reason to believe that disclosure of his identity may put him in danger if returned to his country of origin.
