UPON the parties agreeing to the terms of this Consent Order
AND UPON the Claimant’s applications for judicial review, interim relief and anonymity dated 29 June 2026
AND UPON the Claimant’s application notice of 1st July 2026
AND UPON the Defendant agreeing not to move the Claimant before the Court has considered this matter and made an order following an inter partes interim relief hearing
AND UPON the Court having considered the documents listed in the cover letter to the application notice dated 01 July 2026
BY CONSENT IT IS ORDERED THAT:
Anonymity
- The identity of the Claimant as a party to these proceedings is protected and shall not be published.
- Pursuant to CPR Rule 39.2(4), there shall not be disclosed in any report of these proceedings, or other publication, the name or address of the Claimant or any details that could lead to the Claimant’s identification. The Claimant shall be known as ZYX.
- Pursuant to CPR Rule 5.4C and 5.4D:
(a) A person who is not party to the proceedings may not obtain a copy of a statement of case, judgment or order from the Court records unless the statement of case, judgment or order has been anonymised in accordance with paragraph 2 above; and
(b) If a person who is not party to the proceedings applies for permission to inspect or obtain a copy of any other document or communication, such application shall be on at least 7 days’ notice to the Claimant’s solicitor.
Case Management Directions
- The Defendant is prohibited from moving the Claimant from her placement pending further order from the Court.
- There shall be an inter partes hearing to be listed no sooner than 14 days after the Defendant’s acknowledgement of service, to consider the questions of interim relief and permission.
- Costs reserved.
REASONS
I have read the Application Notice, draft consent order and the documents listed in the cover letter dated 01 July 2026 and consider it appropriate to make the order sought by consent. In relation to the anonymity order, I am satisfied that notwithstanding the principle of open justice, the circumstances of this case justify the making of the anonymity order sought.
