(1) By Appellant’s Notice filed on 19 February 2025, the Appellant (Defendant below) Adcamp LLP, appeal the decision of Mr David Halpern KC, sitting as a Judge of the High Court, judgment being delivered on 30 January 2025.
This is an appeal by the First Defendant (“Adcamp”) against the dismissal of its application under CPR 17.2 to disallow an amendment made under CPR 17.1(1), whereby the Claimants substituted Adcamp for BDB Pitmans LLP (“BDB Pitmans”) as the First Defendant in these proceedings. Permission to appeal was granted by the learned Judge below.
(2) By Appellant’s Notice filed on 1 December 2025, the Appellants (Defendant and Respondent below) BDB Pitmans LLP & Adcamp LLP, appeal the order of Caroline Shea KC, sitting as a Judge of the High Court, dated 7 November 2025.
The appeal is against the declaration that the Claimants are entitled to substitute Adcamp LLP for BDB Pitmans LLP as Defendant in the event that it is found or agreed that BDB Pitmans LLP has not acquired any liability which Adcamp LLP may have had to the Claimants (whether by way of novation or the doctrine of acknowledgement) and that BDB Pitmans LLP is not estopped from denying that it has acquired such liability.
