Issue: the extraterritorial scope of the Competition and Market Authority (CMA’)s investigatory powers under section 26 of the Competition Act 1998 (CA 1998).
Two sets of proceedings regarding the issue were before the Court:- (1) an appeal by Bayerische Motoren Werke AG (BMW AG ) made to the Competition Appeal Tribunal (CAT)
(2) an application for permission to bring a claim for judicial review by Volkswagen Aktiengesellschaft (VW AG) made to the Administrative Court.
