(1) By appellant’s notice filed on 26 May 2023, the appellant/claimant appeals the order of HHJ Khan, sitting in the County Court at Burnley, dated 30 March 2023, whereby he dismissed the appeal against the order of DDJ Wilcox, dismissing his claim, and ordered summarily assessed costs against the claimant.
By order dated 22 June 2022, DDJ Wilcox dismissed the claimant’s standard mortgage payment protection insurance (“MPPI”) claim following an application by the defendant for summary judgment/strike out. The claimant had alleged that the MPPI policy was mis-sold by the defendant Building Society. Relief was claimed under s.140 of the Consumer Credit Act 1974.
(2) By Appellant’s Notice filed 15 September 2023, the Claimant/Appellant appeals the order dated 26 July 2023 of HHJ Owen sitting in the County Court following judgment on 26 July 2023 dismissing the appeal of the order dated 1 February 2023 of DDJ Smith sitting in County Court following judgment dated 27 January 2023 dismissing C’s PPI claim, following a preliminary trial on compromise.
