Appeal 1 – By Appellant’s Notice filed on the 21 February 2023, this is an appeal against the decision of the Upper Tribunal Immigration and Asylum Chamber dated 7 November 2022 whereby they set aside the previous decision of the First Tier Tribunal and dismissed the appeal.

In the Upper Tribunal proceedings the Secretary of State appealed with permission from the decision of the First-tier Tribunal allowing the claimant’s appeal against her decision on 5 January 2022 to refuse him settlement as the extended family member of a relevant EEA citizen pursuant to the Immigration (Citizens’ Rights Appeals) (EU Exit) Regulations 2020) and Appendix EU to the Immigration Rules HC 395 (as amended). The claimant is a citizen of
Albania.

Appeal 2 – By Appellant’s Notice filed on the 17 August 2023, this is an appeal by the Secretary of State against the decision of the Upper Tribunal Immigration and Asylum Chamber dated 13 March 2023 whereby they allowed the appeal against the First Tier Tribunal decision.

In that appeal, the appellant appealed the respondent’s decision dated 30 May 2021 to refuse to grant
leave to remain under the EU Settlement Scheme as the family member (dependent brother) of a relevant EEA national. The appeal was brought under The Immigration (Citizens’ Rights Appeals) (EU Exit) Regulations 2020 (‘the CRA Regulations 2020’).
