(1) By appellant’s notice filed and sealed on 16 August 2023, the Defendant (D) appeals the order of HHJ Luba KC dated 26 July 2023 sitting in Central London County Court

One order granted D permission to appeal DJ’s Bell’s order dated 16 February 2022 and then dismissed D’s appeal, made costs orders, and referred to varying the order of DJ Bell.

The other order amended the order of DJ Bell dated 16 February 2022 under the slip rule (inter alia) so as to make an outright possession order on a mandatory ground.

(2) By Appellant’s Notice submitted 10 November 2023 ,originally filed in County Court on 21 July 2023,the Defendant below, appeals, with permission from HHJ Luba KC, the order of DDJ Samuel dated 30 June 2023 granting the application of the Mayor and Burgesses of the London Borough of Brent, Claimant below, for amendment of the Particulars of Claim.

The issue on both appeals is does the County Court have power on a landlord’s application to vary an existing suspended possession order made on discretionary grounds, to an outright possession order on a mandatory ground?
