By Appellant’s Notice filed on 30 May 2023 and sealed on 12 June 2023, collectively DAF, appeal the entirety of the consent order made by Michael Green J dated 3 March 2023. That incorporated the CAT’s judgment dated 7 February 2023. They also seek to set aside Michael Green J’s order dated 24 May 2023 that DAF pay the Claimants’ costs of the proceedings. That order followed the CAT’s PTA and costs Ruling dated 16 May 2023.
Challenge to Competition Appeal Tribunal (CAT) decisions in one of the first competition damages cases to reach a final quantum judgment. The claims brought by the BT Group (BT) and Royal Mail Group (RM) are the first of many “follow-on” claims in the CAT against truck manufacturers in this jurisdiction, including collective proceedings by the Road Haulage Association (collectively the Trucks Litigation) , to go to trial. Guidance on the principles, nature of discretion and approach to evidence in assessing quantum is needed.
