By Appellants Notices filed on 28 March 2023, the Appellant, in the County Court and the Court of Appeal, appeals HHJ Backhouse’ s order dated 7 March 2023, sitting in Central London County Court.
The Judge varied the award dated 20 August 2021 made by the Third Party Surveyor, by reducing it, made a costs order against the Appellant; that he should pay 75% of the Respondents’ costs, and also ordered him to make a payment on account of costs.
There is a joint judgment dated 7 March 2023.
The Appellant is a building owner, and the two sets of Respondents in are adjoining owners, within the meaning of section 10 of the Party Wall etc. Act 1996 (“the Act”). The issue relates to property damage caused when the appellant commenced works in the garden of the relevant property.
