Appeal against the decision of the Upper Tribunal Immigration and Asylum Chamber promulgated on 4 December 2023.

The Appellant is a citizen of Morocco born in Italy. He returned to Morocco aged 7 years and lived with his family. He entered the UK clandestinely when he was 16 years old but applied for asylum when he was 19 years old. His application was based on his fear of persecution due to his political opinions he shared online about the Moroccan King and government but was refused by the respondent in a decision dated 23 August 2019. The First Tier Tribunal dismissed the protection element but allowed the appeal on his Article 3 and 8 rights.

The respondent appealed to the Upper Tribunal who found that the decision could not stand and remitted the matter back with no findings of fact or credibility preserved.
