By Appellant’s Notice filed on 15 February 2023, the Secretary of State for Work & Pensions (SSWP), appeal the decision dated 1 September 2022 of the Upper Tribunal (Administrative Appeals Chamber).
The Upper Tribunal allowed an appeal by AM from a decision of the First-Tier Tribunal (Social Entitlement Chamber) (FTT) dated 25 March 2021. The FTT’s reasons are dated 27 October 2021 and were issued on 5 November 2021.
Issue: the case concerns the backdating of claims for Universal Credit, and in particular whether a failure to specifically request a claim be backdated precludes the claim from being backdated.
