This is an application by the intervener, Government Legal Department, to debar reliance not raised below and for an extension of time to file a skeleton argument.
The main appeal, which has not yet been listed, relates to the costs condition imposed by the First Tier Tribunal. The Upper Tribunal allowed the appeal and set aside the FTT reviewed decision. The UT held that the Costs are irrecoverable from those of the respondents who hold qualifying leases within the meaning of section 119 of the Building Safety Act 2022.
